2. Object

This legal notice regulates access to and use of the website and the Qomanda application (hereinafter, the "Service"), which ALTURE DIGITAL, SL makes available to the restaurant establishments that contract it and to the people who make a reservation through the reservation engine of said establishments.

Access to the Service confers user status and implies acceptance of this legal notice. The economic and contractual conditions of the subscription are governed by the Terms of service.

3. Terms of use

The user agrees to use the Service diligently and not to use it for activities contrary to the law, good faith, or public order. In particular, the user agrees not to enter false data or data belonging to third parties without their authorization, not to attempt to access restricted areas or data from other establishments, and not to perform any actions that could damage, overload, or impede the normal operation of the Service.

4. Responsibility

ALTURE DIGITAL, SL provides the Service with the required professional diligence, but does not guarantee its uninterrupted availability, as it may be affected by causes beyond its control, including interruptions from infrastructure providers, communications networks or force majeure events.

The contractual relationship with the person making a reservation corresponds in all cases to the restaurantALTURE DIGITAL, SL is the entity that decides on the acceptance, modification, or cancellation of reservations and provides the catering service. ALTURE DIGITAL, SL acts solely as the provider of the technological tool.

5. Intellectual and industrial property

The software, code, design, the "Qomanda" trademark, and all other elements of the Service are owned by ALTURE DIGITAL, SL or by third parties who have authorized their use, and are protected by intellectual and industrial property laws. Subscribing to the Service does not imply any transfer of these rights, but only a license to use them for the duration of the subscription.

The content that the establishment incorporates into the Service (trade name, logo, menu, photographs and customer data) remains its property.

6. Data protection

The processing of personal data is governed by the Privacy Policy and, with regard to cookies and similar technologies, by the Cookie policy.

7. Applicable law and jurisdiction

This legal notice is governed by Spanish law. For the resolution of any dispute arising from access to or use of the Service, the parties submit to the courts and tribunals that are competent in accordance with applicable regulations.
